Zoning Board Considers Revised Policy on Screening of Swimming Pools

(Updated12/9/2021) The Scarsdale Zoning Board of Appeals considered amended requirements for fencing and screening around swimming pools at a work session on December 8, 2021.

According to Village Planner Greg Cutler, “The review of the policy statement on swimming pools was triggered by the chair’s concerns that it has been over two decades since any changes were made. The proposed changes are intended to make the policy statement match the board’s practices. As it relates to the screening questions the proposed language is meant to clarify the existing practice of requiring continuous evergreen screening to a height of five feet. The other change, which is more minor, is that the board feels it is no longer necessary to require the pool equipment be screened from the interior of the lot."

We also asked Cutler, ”This month’s agenda includes the construction of 15 more pools - some in areas where flooding occurred this year. Has anyone considered the overall impact on flooding of all these pools? What are your thoughts?

He said , “Any pools that are being constructed in a regulated floodplain must receive a flood plain development permit and be built in accordance with our floodplain development laws. However, those types of permit request are limited. There was widespread flooding this year- and in many cases it occurred outside regulated floodplains. Most pool applications are not in FEMA Special Flood Hazard Areas and are only required to manage storm water through attainment of a storm water permit. Storm water permits are reviewed by the Village Engineering Department.”
