nadlerspatioThe Nadler's patio at 171 Brite AvenueAfter a lengthy battle, the owner of a home on Brite Avenue in Greenacres has lost his campaign to prevent the construction of a series of tall retaining walls topped by fences on the hill behind his home. Realtor Mark Nadler has lived and worked in Scarsdale for years, but when a developer purchased a home at 4 Kingston Road, directly above his house, he learned that the Village of Scarsdale does little to protect the rights of homeowners.

Nadler’s home at 171 Brite Avenue sits on the bottom of a hill with a 40% slope that extends from the neighbor’s yard down to his patio. The slope is currently heavily covered in trees and shrubs which hides the neighboring home and is a nice backdrop for his patio.

However a developer bought 4 Kingston, the longtime home of Scarsdale Bowl winner Jane Bedichek, and plans to expand the house, add a pool and extend the flat portion of the backyard by building retaining walls and backfilling the yard. Joseph Ciarletta, of EJK 4 Kingston LLC, bought the property for $1.15 million in October 2019 and plans to more than double the size of the house to build an 8,000 square foot home with a pool.

That’s where the trouble for Nadler comes in. This series of retaining walls will extend across the entire hill, and some will be topped with fences. The primary retaining wall is 120’ long and 12 feet from Nadler’s property line. Some of the walls are 16 and ½ feet high. The house will loom 57” above his home and be visible from all sides.

In order to stop the work Nadler gathered 750 signatures from neighbors objecting to the project and appeared to have some success at a meeting of the Board of Architectural Review in January when they denied the developer approval. Ciarletta resubmitted plans for the March 1, 2021 BAR meeting and moved the pool to the uphill side of the property. However, he continued to pursue the expansion of the yard with the installation of tall retaining walls on the hill.photosimulationA photo simulation of what is view will be once the walls are installed.

This project was last on the BAR agenda and the discussion did not begin until after 10 pm. The chair repeatedly asked everyone to be brief and did not give Nadler’s experts, who he retained at his own expense, the opportunity to present their findings. Nadler says, “The chair did not permit my hired professional experts to present the plans, showing the changes as they had been made by the developer. The microphone of the developer was left open and he interrupted, contradicted and then called us “liars and manipulators” before threatening legal action. The chair of the BAR did nothing to control this meeting and as a result, WRONG information was allowed to be presented again, making a farce of this approval process. The chair evidently ran out of patience, or energy and despite several BAR members having objections and wanting conditions made prior to approval of the plan, called for a straw vote, and then, knowing that it would be approved, put it up for vote, where it passed.” (By a vote of 4-3).

Village code governing the BAR does give them the power to deny approval for landscaping plans. Specifically it says:

Features and suitability
In considering an application for a permit, the Board shall take into account natural features of the site and surroundings, exterior design and appearances of existing structures and the character of the district and its peculiar suitability for particular purposes, with a view to conserving the values of property and encouraging the most appropriate use of land.

Grounds for Approval
The Board may approve any application referred to … upon finding that it would not mar the appearance of the area, would not impair the use, enjoyment and desirability and reduce the values of properties in the area, would not be detrimental to the character of the neighborhood, would not prevent the most appropriate development and utilization of the site or of adjacent lands and would not adversely affect the functioning economic stability, prosperity, health, safety and general welfare of the entire community.

However, unlike Greenburgh and many neighboring Villages, Scarsdale does not have laws requiring special permits for building on steep slopes.

proposedpanorama

Nadler cannot appeal the decision of the BAR to the Board of Trustees, so if he wishes to pursue this further, he will have to sue the Village. Frustrated and angry, Nadler wrote the letter below to the Mayor:

Dear Mr. Mayor,

Prior to the January BAR meeting you had assured me that we would receive a fair hearing and be allowed to present our information when we spoke prior to the BAR meeting in January. Indeed, that did happen and the approval was not given. No such hearing was conducted last night and approval WAS given, despite the number of retaining walls increasing, the length of the walls increasing and the addition of fences on top of the walls!

Please watch the recording of the discussion on 4 Kingston Road that happened at the BAR meeting last night and explain why we were not provided the same opportunity to present our information. The chair admonished us to NOT repeat ourselves since it was so late, prevented my experts from showing the plans that the builder had presented to us WITHOUT RETAINING WALLS or the destruction of the slope, told the BAR members to limit their questions since it was late.

The builder was allowed to have an open microphone for the entire meeting, constantly interrupted the BAR members, my experts and me, threatened us, called us “liars and manipulators” and was not controlled at all.

I am outraged at the way this part of the meeting was run and the unfair result that was delivered despite the facts we had prepared and presented (limited as we were) versus the inconsistencies and misrepresentations of the submissions made by the applicant. One example was the photos of the new “boulder wall” which a BAR member astutely pointed out did not match the description in the plan. The chair dismissed this plus many other important pieces of the discussion such as that the landscaping plan does not match the renderings the applicant displayed of my backyard. These are the same type of misrepresentations that happened at the June meeting and led the improper approval of the project then.

The chair completely failed to run or control this meeting and despite the retaining walls getting longer and multiplying with fences on top of them (versus what was presented in January), the vote was rushed and shoved through 4-3 in favor of the applicant despite several of the BAR members asking for conditions to be made for the approval. The chair must have decided that he could not permit the meeting to run any longer since it was after midnight or he wanted to be permanently done with 4 Kingston.

The bar failed to get it right last night and you can now add 4 Kingston Road to the growing list of construction projects that everyone points to and says, “How was that ever approved?”

Watch the recording and tell me if you disagree. Otherwise, I would like to hear how you are going to correct this situation.

Sincerely,
Mark

Nadler received a swift response from Village Planner Greg Cutler who offered little solace. He said,

Dear Mr. Nadler,

Your email to the Mayor was forwarded to me for response. Thank you for your comments regarding the recent Board of Architectural Review meeting. Please note that the Board of Architectural Review operates independent of the Mayor and Board of Trustees. The Board of Trustees convenes on an annual basis to appoint members to the land use boards, including the Board of Architectural Review, but once members are appointed they review applications in accordance with Village law and without the involvement of the Mayor and Board of Trustees. Your comments are certainly noted but it would be inappropriate for the Mayor or Board of Trustees to comment on the substantive or procedural aspects of a matter that had been considered by a Village land use board.

Best regards,
Gregory Cutler, AICP

2cooperaerialWhile the Board of Trustees deliberates on the fate of a historic home at 11 Dolma Road, an application to take down another iconic Scarsdale home has been filed for consideration at the February 23, 2021 meeting of the Committee for Historic Preservation. Perhaps one of Scarsdale’s oldest and largest homes, and certainly one of the grandest now faces an uncertain future. The application can be viewed here.

The 10,656 square foot , 21-room Colonial Revival mansion at 2 Cooper Road was built in 1914 and features a grand stairway and rooms for every occasion, including a game room, a music room, a library, an upstairs family room with built-in bar, and a third floor with spacious accommodations for staff or guests. There are 10 bedrooms and 8 bathrooms and a tennis court. There was originally a guesthouse, a pool, and a 5-car garage.

In 2013 the home was selected to be a Designer Showhouse of Westchester, and 20 designers decorated various rooms on the property. Contributions from visitors benefited the nonprofit Cerebral Palsy of Westchester.

The 27-room home on 3.75 acres at 2 Cooper Road was put on the market in 2014 for $16.5 million, but languished until it was ultimately sold at auction for $6.050 million in June 2018.

The purchaser at the auction was local developer Bobby Ben Simon who attained permission from the planning board to subdivide the property into three lots in 2019. Subsequently he applied to demolish the 5-car garage and servant’s quarters in 2019 to make way for the division of the property. His plan includes two more homes to be built on Cooper Road. It is not known whether he has been successful at selling homes on these two lots.

Ben Simon has been attempting to sell the house at 2 Cooper Road and remaining 1.59 acres, dropping the price to $2.675 million but apparently still not finding a buyer. Now he claims that the house has no historic significance and he has applied to take it down. His application was filed with the Village for the February 23, 2021 meeting of the Committee for Historic Preservation.

Perhaps even more interesting than the house itself are the stories of the people who owned the house during its 107-year history. The home’s owners included titans of industry, men of wealth and surprisingly, an oil tycoon and alleged Nazi collaborator who assisted Hitler’s efforts during World War II.

The first owner was John T. Kelly who purchased the original 4 acres in Scarsdale Estates and built the house in 1915. Kelly was a founder of the Kelly and Jones Company, manufacturers of brass and iron fittings and valves. The company was formed in Greensburg, Pa., and established branches in New York, Pittsburgh, Chicago and San Francisco. He remained as its active head until October 1925, when it was sold to the Walworth Company of Boston. Mr. Kelly died in Scarsdale at the age of 74 in September 1927.

Following Kelly’s death, the home was purchased by Arthur H. Spero, a stockbroker from Rye, who bought the estate on Cooper Road, for a reported price of $225,000.

The most infamous owner of the estate at 2 Cooper Road was undoubtedly William Roades Davis, who, after his death, was accused of being a Nazi sympathizer. Rhodes supplied petroleum to Nazi Germany to fuel the war effort and made political contributions in the U.S. to influence policy toward Germany with the personal approval of Hitler. His playbook was perhaps a presage to some of the actions political operatives took recently to influence U.S. politics on behalf of Russia and to undermine the presidential election.

Davis, born in Montgomery Alabama to “parents in reduced circumstances,” and he claimed that he was a direct descendant of Cecil Rhodes on the maternal side and of Jefferson Davis on his father's side. He started out selling candy on railroad trains and eventually became one of the biggest independent oil promoters in the world.” His obituary says, “It is said that he had “won and lost millions in thirty years of operations in the Western Hemisphere, in Europe and in Africa." After attending Stark College in Alabama for a short time, he became a candy salesman on the Texas and Pacific Railroad, then a fireman and later a locomotive engineer. In 1913, he organized an oil and gas company in Muskogee, Oklahoma. During the World War he served with the A.E.F. in France in the Twenty-first Engineers Light Railway detachment and was discharged as a second lieutenant in 1920.”

In 1933 Davis built an oil refinery in Hamburg, Germany and served as the principal negotiator of an arrangement that allowed Germany and Italy to build up their oil reserves in the years before World War II using expropriated Mexican oil, until the British blockade put an end to the enterprise.

In 1940, Davis arranged for multiple contributions, evading the restrictions of the Hatch Act, to back Republican presidential candidate Wendell Willkie’s campaign to defeat FDR, without Willkie's knowledge. During the 1940 U.S. elections, Davis used funds provided by the German government to contribute approximately $160,000 to a Pennsylvania Democratic organization to help defeat Sen. Joseph Guffey, a Democrat and a prominent critic of Germany, and to bribe the Pennsylvania delegation to the 1940 Democratic National Convention to vote against Roosevelt, moves which both failed. The German government allocated $5 million, stored at the German embassy, to support Davis's efforts.

In December 1940, Verne Marshall, head of the 'No Foreign War Committee,' claimed that Davis, upon returning from a trip to Germany in 1939, presented the State Department with a peace plan representing Hermann Göring's views and called for President Roosevelt to serve as mediator between the warring nations. Marshall criticized FDR for failing to take advantage of the opportunity, but most viewed the plan as an attempt to impose a "German peace.” The German government denied any knowledge of such a plan.

On December 31, 1940, in reaction to Davis's role in forming and financing the 'No Foreign Wars Committee,' U.S. Senator Josh Lee (D-OK) said Davis's support of the new group represented "the diabolically cunning betrayal of the American people." He continued, “The record of this man Davis shows conclusively the great financial stake he has in a complete Nazi victory in the European war. Much of the gasoline sending showers of fiery death into the defenseless heart of London was sold to the German government by this man Davis.... He is still trying to promote a phony peace through the White House to pull Nazi Germany's chestnuts out of the fire.... The 'No Foreign Wars Committee' is a timely object lesson in the technique of all Nazi infiltration.”

In response, Davis said he was loyal to the US and hoped to negotiate peace to end the war. He distanced himself from Marshall and the DavisWilliam Roades Davis: Photo Credit Library of CongressNo Foreign War Committee while expressing sympathy for its aims. He asked Sen. Burton Wheeler, a prominent isolationist, to call him before a Senate committee so he could defend himself against "an organized nation-wide campaign ... by financial and competitive interests.”

On January 7, 1941 he was subpoenaed to testify before a Washington, DC, grand jury investigating campaign expenditures for violations of the Hatch and the Corrupt Practices Acts during the 1940 presidential campaign. The same day, Wheeler scheduled Davis to testify before the Senate Interstate Commerce Subcommittee about the "peace place" described by Marshall.

Some people regarded Davis as a profiteer; others as a man who would furnish needed markets for Mexican oil; and others as a ... Nazi agent or as a crook. In reality, he was a composite of each of these descriptions.

Davis died of a heart attack in Houston, Texas, on August 2, 1941. A few years after his death, Davis was named in Assistant U.S. Attorney General O. John Rogge's Nazi Report identifying him as Abwehr agent C-80, not a spy but an "agent of influence" whose activities were financed with the personal approval of Hitler, and who in that role supplied petroleum to Nazi Germany and helped Germany try to influence U.S. politics.

The United States government released captured Nazi government documents in 1957 showing how Davis funneled Nazi funds into the 1940 U.S. elections.

Jack Wasserman and Sol Berger

The next owner on record is Jack Wasserman a dress manufacturer from New York who then sold it to Sol Berger for less than $100,000 in 1953. The home stayed in the Berger family for over 60 years until it was auctioned in 2016. Berger founded and ran a shirt manufacturing company in Woodbury, Tennessee where his company eventually grew to employ 2,200 people. Additional plants were opened and at one time numbered 20 factories.

According to the Cannon Courier, "It is estimated that Mr. Berger was directly responsible for pumping approximately $200 million into the economy of Cannon County (Tennessee) in the form of payroll checks alone. In today's dollars, that would amount to more than $200 billion. This made it possible for one to see new washing machines on the front porches of homes in every section of the county in the late 1940s and early 1950s. Later we saw new homes, shiny new cars and pickup trucks everywhere. Television antennae were growing from every rooftop. Inside plumbing, add-on rooms and new appliances and new furniture were enjoyed in almost every home....There is not a single home in the county that was not affected by the presence of Colonial Corporation of America. Families were able to send their children to college. The quality of life of most of our people vastly improved due in part to the economic growth caused by the presence of Colonial Corporation of America."

Berger sold the company in the 1960's and then went into investing in real estate. He died in 2009 and is survived by two daughters, Renee and Sandy Berger, and their children and grandchildren who sold the house to current owner Bobby Ben Simon.

LawrenceGrahamAttorney Lawrence Graham passed away on February 19.Those who are focused on historic preservation in Scarsdale will be interested in a strange turn of events concerning an application to demolish a Normandy style farmhouse built in 1928 at 11 Dolma Road.

The applicants filed an application to take down 11 Dolma Road with the Committee for Historic Preservation in 2020by Lawrence Graham of Cuddy and Feder in White Plains who had considerable experience in the field.

Unhappy with the result, they appealed that decision to the entire Board of Trustees of Scarsdale who heard their case on February 4, 2021. At this most recent hearing Graham was joined by Andrew Shriever in making their case that the committee’s ruling should be overturned.

The Village was represented by James Staudt, who summed up the case saying, “If ever credit should be given to the CHP it is in this case. There are 600 pages of documentation. The record demonstrates that both sides were afforded opportunities to supply evidence…. The decision provides clear articulate reasons and thoughtful discussion of how Julius Gregory advanced architecture into the modern age…. it is difficult to fathom a more thorough process.”

Following the hearing the Village Board deliberated in executive session, so their thoughts on the matter were not made public. They later said they would announce their decision at a future meeting of the Village Board and the matter was on the agenda for the February 23, 2021 meeting.

However, at the 2/23 meeting, Mayor Marc Samwick said, “There was a very unfortunate incident. One of the attorneys on this matter passed away over the weekend.” He requested to move this item to the next meeting and took a vote of the board and the move to table passed unanimously. Asked later why the matter was tabled, Samwick said, “We felt that, out of respect for the loss of the lead advisor to the owner, and to provide the owner the opportunity to be in front of the village with a full team, it was reasonable to defer this item for two weeks.”

Samwick was referring to Lawrence Otis Graham a 59 year-old lawyer and author who was well known around the county. He died this past weekend. No cause of death has been provided.

Graham was a graduate of White Plains High School and lived in Chappaqua at the time of his death. He attended Princeton University and Harvard Law School. He was a New York Times bestselling author of 14 books and was a contributing editor at U.S. News & World Report. He offered weekly commentary on Cablevision News 12 TV, which keeps him in contact with the top government officials in the region. Larry has served as legal commentator for WNBC and has appeared on “The Today Show” and PBS’ “Charlie Rose.” His corporate and legal research has appeared in USA Today and The Wall Street Journal.

Remembering Graham, County Executive George Latimer said, “His writing particularly struck a chord as he described growing up Black, well-educated, articulate and accomplished, and still facing prejudice and racism in this society.” He continued, ““I met him when he and his wife Pam - a talented and successful executive in her own right - lived in White Plains and I was going door-to-door running for re-election as a County Legislator,” Latimer said. “I walked away from that front door meeting knowing I had just met an impressive man... and he was that and more over the 25 years of our friendship.”

So now, nine months after the original application there is still no decision on 11 Dolma Road.

At the same time as the Village Board was meeting, the Committee for Historic Preservation was in conference to consider an application to raze another historic home, this one at 2A Cooper Road.

Builder Bobby Ben Simon has already subdivided the original 3.75 acre property in anticipation of building two additional houses on the property. Unable to sell the original home, he was granted permission to take down a large garage with servants’ quarters and proceeded with that demolition. Now he has applied to take down the 21-room, 10,656 square foot Colonial Revival home built in 1914.

However, his application provided no historic information on the home, leaving the Committee for Historic Preservation to do the research. They have asked architectural historian Andrew Dolkart to help them learn more about the provenance of the home and, if possible, name the architect who is not identified on the original plans.

In order to give the committee and Dolkart time to do some research, Committee Chair Adam Lindenbaum proposed to hold the application over to the committee’s next meeting on March 23, 2021. They encouraged neighbors or anyone with knowledge about the home to contact Frank Diodati in the Building Department who will relay the information to the committee. After the committee discusses the information, there will be opportunity for public comment.

Conversion of homeowners’ associations (HOA) and single-family homes to a condominium form of ownership can result in significant tax savings for these property owners (by as much as 50%), while shifting the tax burden to the balance of Village property taxpayers.”

Since condominiums are valued on their potential rental income rather than their market value, this would have resulted in lost tax revenue for the Village. The Board agreed that it was best to close this loophole as soon as possible and voted yes on this resolution.
