Village Manager Provides Status of 2014 Tax Grievances

So, what happened to all the grievances filed after the 2014 real estate tax revaluation – were taxes reduced? At the August 11th Village Board meeting, Village Manager Steve Pappalardo reviewed the status of all the tax grievances filed in 2014.
He reported the following:
The total number of grievances filed was 950, and the Board of Assessment Review considered all and reduced taxes for 163 of the applicants.
Following their review, 730 appeals
were filed by applicants who did not receive reductions and as a result, 469 of these were settled, 30 went to trial and 19 received reductions.
146 certiorari cases were filed. According to Pappalardo, these are more involved legal proceedings that take years to settle. Out of those 146 cases, only one has been settled and 145 are pending.
The Village lost $154 million in assessed value across the appeals, which is a reduction of about 1.87%. The Village will make up this tax revenue loss by increasing taxes across all residents.

Readers Comments on Preservation and Demolitions

Last week the Scarsdale Committee for Historic Preservation voted to preserve two homes and to clear the way for demolition of several more. We received many comments about the news from readers.... some about the preservation process and others about the members of the committee... when an architect who serves on the CHP also signed the application to demolish 11 Carstensan Road. See below for a few thoughts from our readers:
#1: I don't think 11 Carstensan is a particularly attractive house. The scale of the timbering on the facade is skimpy and the window sizes and shapes are not particularly attractive. It seems sort of like a Tudor - craftsman hybrid. And 1023 Post Road isn't likely to appeal to most buyers. Anyone who buys it won't have any economic incentive to do long-term, high-quality renovations, So it will sell cheap and get run down. That is NOT the best outcome for the neighborhood. Wouldn't it be better to create stricter architectural guidelines for ALL new homes, instead of imposing extreme penalties on a small minority of homeowners who want to demolish existing structures? I see so many multimillion dollar new homes in Scarsdale with glaring architectural defects. I bet these homes have the highest quality interior finishes, but the designs and lot placements are AWFUL! Misplaced stone facades, poorly sized dormers, snap on shutters, ugly roof lines, oversize for the lot... creating higher architectural standards for new construction would remove some of the economic incentive to demolish, without somewhat arbitrarily penalizing a small minority of homeowners. There many attractive homes in Scarsdale that date from 1900 - 1930. These are old homes, and many have had ill-advised renovations during their 100-year life spans. As time goes on, it will make sense to demolish more and more of these. Rather than impose draconian penalties on the owners of these homes, why not do something to ensure that the replacement homes will add as much to their neighborhoods in 2115, and some of these home do now?
#2: Shame on Choura: The corrupt face of developers architects trying to line their own pockets while appearing to volunteer their time is there for everyone to see. I would hazard a guess that Bana sold her services to the owner on her special ability to obtain the approval of demolition. The committee at the minimum should dismiss Choura and consider banning all people who live off the profession in town. What more evidence do you need of blatant abuse of position?
#3 I respect the people who have donated their time and energy to serve on the committee but more rules need to be put into place to preserve the homes, character and overall feel of the town. I live down the street from 110 Brewster Road. I am disgusted that this house will be torn down. The property is only .17 acres!! What will be built on that tiny lot that is worth it?! The house will likely overwhelm the property, tower over neighboring homes (see current homes being built on Huntington and Brewster Road). A particular HOME may not be deemed overall "historical" but a home that is nearly 100 years old is adding to the charm and character of this town. It is sized appropriately on the lot in comparison to neighboring homes and creates an overall community feel. The town is losing this. Please be careful.
#4: It's difficult to understand the need to demolish 110 Brewster but I'm sure builder will speculate that a new home towering over its neighbors with a prominent two car garage will sell.

Home Building Continues Despite Gravel Moratorium

Is the Scarsdale building moratorium on homes that use gravel to meet lot coverage requirements causing a decrease in the number of building projects or demolitions? The Scarsdale Board of Trustees enacted the moratorium in February 2015 and recently extended it to October 2015 to give themselves time to study the issue.
At the hearing on the extension of the moratorium, a builder complained that the moratorium was impacting his business and a homeowner said that it prevented him from filing plans to construct a swimming pool.
In order to figure out if the moratorium is having an impact, we looked at the numbers and spoke to a few experts. From what we can see, the moratorium has not caused a decrease in building activity around Scarsdale.
First, we looked at the number of applications to the Committee for Historic Preservation for home demolitions. Here's the data for the last several years:

This chart shows that the number of applications is very steady.
Next we asked Village Planner Elizabeth Marrinan for her observations, and after looking at the data and the traffic at the building department she said, "As for your question as to whether the moratorium seems to have slowed permit applications, from what I see and hear, I think the answer is no."
Realtor and member of the Board of Architectural Review Jack Miller said, "I do not believe that the moratorium is meant as a punitive measure (as a few builders have expressed), but rather a way for the Village to gain some space to make a well informed decision about building codes, especially FAR, setbacks, and massing guidelines as they move forward.
I haven't seen a drop in applications for new homes or renovations, and judging by the CHP agenda they too haven't seen a drop in demolitions.
As far as "economics" go, it seems that the younger Millennials moving out from the city want NEW construction. They are a well-educated group of hard working young folks who don't want to be bothered with the day-to-day maintenance and continual upkeep of older homes. I heard a funny story about a young gentleman who just purchased a very expensive new home knocking on his neighbor's door to borrow a hammer. Who doesn't own a hammer?"
Last we got the following comments from Paul Fontana of the Cum Laude Group, popular contractors in Scarsdale:
"One important distinction to understand is the difference between the following requirements which are related, but not the same:
1) Lot coverage, which is the amount of space on a property that is covered with impermeable substances. This can be the actual house, driveways, patios, walls or anything else through which water does not pass.
2) FAR, which is the size of the living space of a house (on all floors, sometimes the basement, depending on the height of the first floor) relative to the size of the lot.
3) Building coverage, which is the size of the footprint of the house and accessory buildings.
The proposed new law about gravel really targets the lot coverage more than any of the other regulations. Developers and homeowners will still design and build houses that will be plenty big, they will just have smaller driveways, smaller patios and probably not have pools on anything smaller than 3/4 acre lots.
Some towns, like Rye and Harrison, have no provisions for lot coverage at all. Permeability of substances is not a criterion at all.
The smaller and middle size lots will be the most affected by this regulation if it passes. The large estates will be still be able to expand their houses and add pools.
This code change will also create a large number of non-conforming houses that will have difficulty renovating in the future.
I suspect that homeowners will design what they have to in order to conform to the new code, but that many will expand their driveways and patios after C.O.s are issued."
